Terms and Conditions

The Contract

A contract between the hirer and owners of Quivive is entered into once a booking has been confirmed following receipt of the completed booking form with a deposit or full payment. The main hirer, whose name appears on the booking form, must be over 18 years old and must take full responsibility for ensuring that the Terms and Conditions are adhered to by all members of the party.

Quivive is made available for the purposes of a holiday let to which Section12 (2) and paragraph 8 of Schedule 4 of the Housing (Scotland) Act 1988 apply. The booking agreement confers a right to occupy the accommodation for the agreed period only.

Payments

A deposit of 20% of the rental cost is payable when booking more than eight weeks before a rental period is due to start. Full payment is required for bookings made less than eight weeks prior to date of arrival.

The outstanding balance is due not less than eight weeks before the start date of the rental, and will be requested together with a refundable security deposit of £250. Failure to make full payment at the appropriate time may result in the cancellation of the booking and the forfeit of the deposit.

Cancellation

The hirer is advised to arrange holiday cancellation insurance to give protection in the event that they are unable, for any reason, to take up the accommodation at the agreed time. For any cancellation before the arrival date, not only will any deposit be forfeited, but the balance of the rental cost will also be payable by the hirer. The hirer should notify the owners of any cancellation immediately in writing. Upon receipt of this information, the owners will try to re-let the property, and if successful will make a refund to the hirer, less the deposit which is non-refundable.

In the unlikely event that Quivive becomes unavailable subsequent to booking, through circumstances beyond the control of the owners, the liability of the owners is limited to repayment of any deposit already paid in respect of the booking.

Occupancy

Occupancy will commence at 4pm on the day of arrival and finish at 10am on the day of departure to allow changeover to commence, unless otherwise agreed with the owners.

The number of persons occupying Quivive must not exceed eight. These individuals must be named on the booking form and only they will be permitted to stay during the booked period, unless the owners have previously approved substitutions. If this condition is breached, or if there is unreasonable behavior, for example causing a nuisance or disturbance to neighbours, the owners reserve the right to terminate occupancy of Quivive without notice and without any refund of payments received. The owners also reserve the right to refuse or revoke bookings from parties that may in their opinion be unsuitable to occupy the property.

Care of the Property

The hirer is responsible for the condition of Quivive and its entire contents during the hire period, leaving the accommodation in good order and clean condition as they found it on arrival. The owner reserves the right to make a charge for extra cleaning if the property is not left in a satisfactory condition.

The security deposit of £250 will be returned to the hirer after deducting the cost of any breakages or damage to the property, loss or damage to linen or towels supplied, or the provision of any extra services required to return the property to its original condition. The hirer will also be liable for any excess over £250, and should inform the owners immediately of any breakages or damage.

General Conditions

It is the hirer’s responsibility to shut all exterior doors and appropriate windows, and to secure the property when absent or sleeping.

The hirer must take all reasonable steps to minimise the risk of fire, and must not use candles in the property, other than for birthday/celebration cakes.

Smoking is strictly forbidden within the property, but is allowed anywhere outside. The hirer must remove all traces of smoking from patios and the gardens by the end of occupancy.

The hirer will be liable for any abuse of conditions of broadband usage. These include illegal downloads and copyright infringement, which could see hefty fines and disconnection, and additional charges for breeching the owner’s ISP’s (Internet Service Provider’s) fair use policy.  Guests should have their own virus protection and children should be supervised.

Under no circumstances are pets allowed at Quivive.

The hirer will not sub-let or re-assign the property to another person or persons without the owners’ permission.

In case any of these conditions are breached, the owners reserve the right to repossess the property during the occupancy period, without notice or refund of payments received.

Liability and Insurance

Responsibility for personal property of the hirer and any guest of the hirer lies with the hirer. All vehicles are also left at the hirer’s risk. The hirer agrees to indemnify the owner against any claims made against the owner by any hirer, guest of the hirer or any other third party arising from the hirer’s occupation of the property during the booking.

The owners can accept neither liability nor loss of any nature whatsoever for the hirers use or hire of any form of equipment during the occupancy. It is the hirers responsibility and he/she is strongly advised to arrange appropriate and adequate insurance to give protection for loss or damage for this purpose.

Small children need to be supervised in the garden as there is a small ditch along one hedge.

Reporting Problems

The hirer should notify the owners if a problem arises, and they will do their best to rectify this as soon as possible, so that the rest of the occupancy period may be enjoyed with the minimum of inconvenience.
